Terms of Service
These Terms of Service (“Terms”) govern your access to and use of CardMe (“CardMe”, “we”, “us”, or “our”), including our website, platform, and any physical cards or add-ons offered through the Service. By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility and accounts
You must be of legal age to form a binding contract in your jurisdiction to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. If you create profiles or accounts on behalf of an organisation, you confirm you are authorised to do so.
2. The Service
CardMe lets you create digital business card profiles, share them by link, QR code, or NFC card, capture and manage contacts, and access related features such as analytics and a contact/deal pipeline. We may add, change, or remove features over time. We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation.
3. Acceptable use
You agree not to use the Service to:
- break any applicable law or regulation, or infringe anyone’s rights;
- impersonate another person or misrepresent your identity or affiliation;
- upload or share content that is unlawful, harmful, deceptive, defamatory, obscene, or otherwise objectionable;
- distribute malware or attempt to disrupt, overload, or circumvent the security of the Service;
- harvest, scrape, or collect data about other users without authorisation, or use bots or other automated means to access the Service without our permission;
- send unsolicited, bulk, or spam communications to people whose contact details you obtained through the Service;
- reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law;
- store or transmit other people’s personal data through the Service in violation of applicable data-protection law;
- resell, duplicate, or commercially exploit the Service without our written permission.
We may investigate suspected violations and may suspend or terminate accounts that breach these Terms, without notice where appropriate.
4. Your content
You retain ownership of the content you add to your profile (such as your name, images, links, videos, and documents). By adding content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display it as necessary to operate and provide the Service — for example, showing your profile to people you share it with. This licence ends when you remove the content or close your account, except for copies retained in routine backups or as required by law.
You represent and warrant that you own or have the necessary rights to the content you upload, and that it does not infringe the intellectual-property, privacy, or other rights of any third party, nor violate any law. You are solely responsible for your content. We may remove or disable access to any content that we reasonably believe breaches these Terms, infringes a third party’s rights, or is otherwise unlawful, without liability to you.
The Service is not a backup or storage service. You are responsible for keeping your own copies of any content that matters to you.
5. Contact-exchange data
The Service allows visitors to share their contact details with you, and allows you to collect and manage those details. If you collect personal information from others through CardMe, you are responsible for handling it lawfully and respecting the privacy of the individuals concerned. You must not use collected contact data for unlawful, deceptive, or abusive purposes.
6. Plans, payments, refunds & cancellation
Some features require a paid plan or one-time purchase, and physical cards and add-ons are sold separately. Prices are shown at the point of purchase and may change over time; any change will not affect a one-time purchase you have already completed. Payments are processed by our third-party payment provider, and by purchasing you authorise the applicable charge.
Subscription (monthly) plans. Recurring plans renew automatically each billing period until cancelled. You may cancel at any time from your dashboard or by contacting us; cancellation stops future renewals, and your paid access continues until the end of the current billing period. We do not provide partial refunds for the unused portion of a billing period unless required by law.
Lifetime (one-time) plans. A lifetime plan is a one-time purchase granting access for the lifetime of the Service — that is, for as long as CardMe continues to operate and offer the Service. “Lifetime” refers to the lifetime of the product, not the lifetime of the purchaser, and is not a guarantee that the Service will be offered indefinitely or forever. If the Service is permanently discontinued, lifetime access ends at that time. A lifetime plan is non-refundable once purchased, except where a refund is required by applicable law or expressly stated.
Digital add-ons. Digital add-ons (such as the CardMe Media Add-on) are delivered immediately and are non-refundable once applied to your account, except where required by law.
Physical cards. Physical NFC cards are made to order. We will replace or refund a card that arrives faulty, damaged, or materially different from what you ordered, provided you notify us within a reasonable time of delivery. Because cards may be personalised, we are not obliged to accept returns for change of mind once production has begun, except where required by law.
Consumer rights. Nothing in this section limits any non-waivable statutory rights you may have as a consumer. Where you are entitled to a statutory cooling-off or withdrawal period (for example, certain consumers in the EU/UK), that right applies in addition to the above; note that supplying digital content immediately, with your consent, may end an applicable withdrawal right.
To request a refund or cancellation, or to ask about your rights, contact us at support@cardme.info.
7. Physical cards
Where you order a physical NFC card or accessory, additional terms relating to production, shipping, and returns may apply and will be made available at the time of purchase. Physical cards link to your digital profile; their functionality depends on the profile remaining active and on compatible visitor devices.
8. Teams and organisations
If you are part of a team or organisation on CardMe, an administrator may manage profiles, settings, and certain data within that team. If you are an administrator, you are responsible for using those controls appropriately and in line with any obligations you owe to your members.
9. Third-party services
The Service relies on and may link to third-party services (such as payment, authentication, hosting, and email providers). We are not responsible for the content, policies, or practices of third parties, and your use of their services may be subject to their own terms. We provide access to any optional third-party tools “as is” and without warranty.
10. Intellectual property
The Service, including its software, design, and branding, is owned by CardMe and protected by intellectual-property laws. These Terms do not grant you any right to use our name, logo, or materials except as needed to use the Service as intended.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, reliability, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that results obtained from it will be accurate.
12. Limitation of liability
To the maximum extent permitted by law, CardMe and its directors, employees, and providers will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose. Because CardMe is designed to transmit the kind of basic contact details found on a physical name card, you accept responsibility for the information you choose to publish or share.
13. Indemnification
You agree to indemnify and hold harmless CardMe and its team from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your collection or use of contact data, or your breach of these Terms or applicable law.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe it is necessary to protect the Service or other users. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will continue to apply.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
16. Governing law
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be subject to the jurisdiction of the courts of Singapore, except where applicable law provides otherwise.
